1. Introduction

Auagro Group PTY LTD ("Auagro", "we", "us", or "our") operates an agricultural commodities trading platform that connects buyers with verified global suppliers and facilitates settlement in USDC on the Base network. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our website, mobile applications, and related services (the "Services").

By using the Services, you agree to the collection and use of information in accordance with this policy. If you do not agree with this policy, please do not use the Services.

2. Information We Collect

2.1 Information you provide

  • Account details: name, email address, phone number, password, preferred language, and time zone.
  • Business and KYC information: company name, business registration number, tax identifiers, trading address, beneficial-owner details, identity documents, and supporting documentation required to verify your business.
  • Transaction information: orders, shipping addresses, invoices, escrow records, dispute evidence, and related correspondence.
  • Wallet and payment data: on-chain wallet addresses, USDC balances, transaction hashes, and any payment instruments you link to your account.
  • Communications: messages you send through support channels, product enquiries to suppliers, and survey responses.

2.2 Information collected automatically

  • Device and usage: IP address, browser type, operating system, device identifiers, pages viewed, referring URLs, and timestamps.
  • Cookies and similar technologies: used to keep you signed in, remember preferences, measure performance, and detect fraud.
  • Location: approximate location derived from your IP address. Precise location is only collected with your permission.

2.3 Information from third parties

We may receive information from identity verification providers, payment and crypto-infrastructure partners (including Coinbase Developer Platform), logistics partners, fraud-prevention services, and public records to verify your identity, prevent abuse, and comply with our legal obligations.

3. How We Use Your Information

  • To create and maintain your account and authenticate you.
  • To verify your identity and your business, and to meet anti-money-laundering, counter-terrorism-financing, and sanctions obligations.
  • To process orders, payments, escrow, and dispute resolution.
  • To operate, maintain, secure, and improve the Services, including detecting and preventing fraud and abuse.
  • To communicate with you about transactions, security alerts, product updates, and (where you have opted in) marketing.
  • To comply with applicable laws, regulations, court orders, and lawful requests from public authorities.
  • To enforce our terms, protect our rights, and the rights and safety of our users and third parties.

4. Legal Bases for Processing

Where the GDPR, the Australian Privacy Act 1988, or similar laws apply, we rely on the following legal bases to process your personal information: performance of a contract with you, our legitimate interests (such as operating and securing the platform), compliance with legal obligations, and your consent where required.

5. How We Share Information

We share information only as described below:

  • Between buyers and suppliers: order, shipping, and contact details necessary to fulfill a transaction.
  • Service providers: cloud hosting, KYC providers, crypto custody and wallet infrastructure, logistics, analytics, customer support, fraud-prevention, and communications vendors who process information on our behalf under written agreements.
  • Blockchain networks: USDC transactions are recorded on public blockchains (such as Base). On-chain data, including wallet addresses and transaction amounts, is permanent and publicly visible.
  • Legal and safety: to comply with the law, respond to lawful requests, enforce our terms, or protect rights, property, or safety.
  • Corporate transactions: in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.

We do not sell your personal information.

6. International Transfers

Auagro operates across multiple jurisdictions, including Australia, China, New Zealand, Vietnam, Thailand, Malaysia, Indonesia, and the Philippines. Your information may be transferred to and processed in countries other than the one in which you reside. Where required by law, we put in place appropriate safeguards such as standard contractual clauses.

7. Data Retention

We retain personal information for as long as needed to provide the Services, comply with legal obligations (including tax, accounting, and AML record-keeping requirements that may require multi-year retention), resolve disputes, and enforce our agreements. When we no longer need information, we delete or anonymise it. Note that on-chain transaction records cannot be deleted.

8. Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and monitoring. No method of transmission or storage is 100% secure. You are responsible for keeping your password and any wallet credentials confidential.

9. Your Rights

Depending on your location, you may have the right to access, correct, delete, or receive a copy of your personal information; to object to or restrict certain processing; to withdraw consent; and to lodge a complaint with your local data protection authority. You can exercise these rights by contacting us using the details below. We may need to verify your identity before responding.

10. Account & Data Deletion

You can request deletion of your Auagro account and associated personal data at any time. This applies to accounts created in the Auagro mobile app and on this website, operated by Auagro Group PTY LTD.

Delete your account in the app

  1. Open the Auagro app and sign in.
  2. Go to Account, then Settings.
  3. Under Account, select Delete account.
  4. Review the deletion notice and confirm.

Once confirmed, your account is disabled and you are signed out. If you cannot access the app, email privacy@auagro.com.au from your registered email address and we will process the request after verifying ownership.

Before you can delete

Because Auagro handles orders, escrow, and payments, we cannot delete an account that still has open obligations. Deletion is blocked while you have orders in progress, funds held in escrow, or an outstanding credit balance. Please complete, cancel, or settle these — or contact support — first.

What is deleted

  • Login access and password credentials.
  • Profile fields such as name, phone number, and avatar.
  • Saved products, push notification tokens, and in-app notifications.
  • Notification preferences.
  • Business application submissions, uploaded account documents, and account addresses.

What is retained

Some records are retained where required for legal, tax, compliance, fraud-prevention, payment, escrow, dispute-resolution, and blockchain audit obligations — including order, invoice, escrow, payment, wallet, and transaction records, on-chain wallet addresses and transaction hashes, and the support and audit logs needed to protect the platform. These are kept for as long as required by applicable law or legitimate business obligations, generally up to seven years unless a longer period is required for disputes, investigations, or legal proceedings. As noted in Section 7, on-chain transaction records cannot be deleted.

11. Cookies

We use cookies and similar technologies to operate the platform, remember your preferences, analyse usage, and prevent fraud. You can control cookies through your browser settings. Disabling certain cookies may affect the functionality of the Services.

12. Children's Privacy

The Services are intended for businesses and individuals aged 18 or over. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.

13. Third-Party Links and Services

The Services may contain links to or rely on third-party websites, wallets, and blockchain networks that we do not control. This Privacy Policy does not apply to those third parties; please review their privacy policies before providing them with information.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the Services or by email. Your continued use of the Services after a change becomes effective constitutes acceptance of the updated policy.
